A buyer asked us to look at a building they were about to purchase, and the lease of the ground floor unit turned out never to have been registered. The tenant had paid rent for eight years and had a signed agreement, a bank account history and no recorded interest in the property at all.
We told the buyer what that meant for them and we told them plainly that the tenant was the one with the problem. The sale went ahead with the position dealt with in the contract rather than ignored in it, and the tenant, separately advised, ended up with a registered lease for the first time since 2016.
The whole thing took nine days because it was found before the money moved. Found afterwards, it is a claim.
